Privacy Policy

GopherWood Lawyers Pty Ltd (ABN 34 692 278 676) ("GopherWood Lawyers", "we", "us") respects your privacy. This policy explains how we collect, hold, use and disclose personal information, in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our obligations of confidentiality and legal professional privilege to clients apply in addition to this policy.

What we collect

  • Details you give us through our website enquiry form, by email or by phone: typically your name, email address, phone number, and a description of your matter.
  • Information needed to act for you once engaged, such as identification, contact details, information about your dispute or transaction, and details of other parties.
  • Information about how you use our website (see "Cookies and analytics" below).

Please do not send confidential or sensitive details of your matter through the enquiry form. A short description is enough for us to respond. We will not act for you, and no lawyer-client relationship exists, until we have confirmed our engagement in writing.

How we use it

  • To respond to your enquiry and assess whether we can assist, including conflict checks.
  • To provide legal services and manage our relationship with you.
  • To meet our legal, regulatory and professional obligations.
  • To understand and improve how our website and advertising perform.

We do not sell personal information.

Who we disclose it to

  • Service providers who help us run the firm and this website, such as email delivery, hosting, practice management and IT providers, under confidentiality obligations.
  • Barristers, experts and other professionals engaged on your matter, with your instruction.
  • Courts, tribunals, regulators or other parties where the law requires or permits it.

Some of these providers may store data outside Australia (for example, in the United States). Where that happens, we take reasonable steps to ensure the information is handled consistently with the Australian Privacy Principles.

Cookies and analytics

Our website uses Google Tag Manager, Google Analytics and Google Ads conversion tracking. These use cookies to collect information such as the pages you visit, how you arrived at the site and whether you submitted an enquiry. This information is used in aggregate to measure and improve the website and our advertising. You can block or delete cookies in your browser settings, and opt out of Google Analytics using Google's browser add-on.

Security and retention

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access. We keep client files for the periods required of law practices, then destroy or de-identify them securely. Enquiries that do not proceed are kept only as long as needed for conflict checking and record-keeping.

Access and correction

You can ask to access or correct the personal information we hold about you by contacting us. We may decline access where the law allows, for example where privilege or another person's privacy is involved, and will tell you why.

Complaints

If you have a concern about how we have handled your personal information, contact us first and we will respond within 30 days. If you are not satisfied, you can contact the Office of the Australian Information Commissioner at www.oaic.gov.au.
