Overview

Employment & Workplace

A dismissal application, a departing executive or an allegation of underpayment can quickly become a dispute about the way a business makes decisions, protects its information and meets its obligations. For employers, the immediate task is to identify the claim, understand the applicable legal test and preserve the evidence that will support a properly considered response. Paying notice, relying on a signed contract or pointing to an internal policy will not necessarily answer the allegation.

GopherWood Lawyers' Employment & Workplace practice is directed exclusively to corporations, employers and businesses. We do not act for employees in this practice area. We advise on defending unfair dismissal and general protections claims, enforcing lawful post-employment restraints, managing executive termination disputes, responding to wage and underpayment allegations, and defending discrimination and harassment proceedings. Our focus is contested employment matters and the business decisions that can prevent, narrow or resolve them.

The work starts with the employment relationship itself: who employed the person, what industrial instrument applied, who made the decision, what was actually communicated and which documents were created at the time. Different disputes belong in different forums. The Fair Work Commission, federal courts, NSW courts and discrimination complaint bodies have distinct powers, time limits and procedures. An employer needs a response built for the correct jurisdiction, not a generic dismissal letter or an assumed compensation ceiling.

We assess legal exposure alongside the operational consequences: continuity of leadership, customer relationships, payroll systems, insurance notifications, board reporting and the effect of proceedings on the wider workforce. A proportionate negotiated outcome may be preferable to a hearing. Where an allegation needs to be defended or business interests need urgent protection, the evidence and relief sought must be prepared with the same discipline as any other consequential commercial dispute.

How we help

Advice and
representation.

We begin with a focused assessment of jurisdiction, deadlines, documents and the business outcome sought. We identify the legal issues that genuinely matter, the strengths and weaknesses of the employer's position and the information needed before a decision is made. Where a claim has already arrived, we prepare the response, test the available objections and plan conciliation or litigation around the evidence.

Our work can include reviewing termination and investigation processes, preparing employer responses and witness evidence, negotiating exit terms and settlement deeds, assessing restraint enforcement and urgent relief, analysing payroll claims, and responding to discrimination complaints. Where technical input is needed, such as payroll reconstruction or digital evidence analysis, that work should be appropriately scoped and coordinated with legal advice.

Employment matters may overlap with commercial contracts, directors' duties, confidential information, regulatory investigations and management liability insurance. We consider those connections without treating a successful response in one forum as the end of every potential claim. Our employment advice and representation remain on the employer side throughout.
